Pine Bush environmentalists lose appeal May 2, 2008
The environmentalists said the company was not protecting or re-establishing the endangered Karner Blue butterfly on the land, as was required by the agreement with the DEC. In the most recent court ruling, the Appellate Court said Save the Pine Bush did not establish specific environmental injury that confers standing under state environmental law. According to the decision, having members of the group go to the site or next to it to observe the butterfly was not enough to confer standing. (Community News Weekly, NY)
