    U.S. District Court Judge Milton Shadur wrote in a memo that there was a lack of required diversity of citizenship in the lawsuit that claimed Mr. FitzSimons along with seven other directors were holding the company hostage by refusing to consider purchase offers for some of its newspapers. Mr. Shadur said he believed that the , as an entity separate from its directors, should be aligned with the plaintiffs in the lawsuit and that would make the case ineligible for federal court.
